The transport department claimed that ads have been banned to ensure no message which is socially unwanted, obscene, vulgar, provoking, anti-social, immoral, enticing, misleading or hurts political or religious sentiments of public can be displayed on these vehicles.
The department cited Delhi Motor Vehicle Rules to argue that it is well within its rights to prohibit such ads as public transport vehicles need to first take its permission to display them, which wasn't done in this case.
Recently, the transport department noticed that commercial vehicles are being misused to display such ads, distracting other drivers, the reply filed in HC said, adding it also led to "deterioration of roads". The department also questioned the logic of the auto drivers that the ban violated their fundamental right of freedom of speech. It said autos are not meant for carrying advertisements but for "carrying passengers at a rate approved by the transport department" and the ban doesn't have any adverse effect on their right to freedom of speech.
Saying auto fares have been hiked, the department claimed the revised fares were adequate remuneration for operators and lack of ads would not affect them financially. The department drew a distinction between the case of autos and radio taxis, contending the latter sought permission, which was granted after studying the effects of ads pasted on them. HC had stayed the government's order prohibiting ads and posters on autos after hearing a plea of a group of auto drivers.
