A division bench, comprising Justices Kailash Gambhir and Indermeet Kaur, set Singh free after they found the prosecution failed to prove beyond reasonable doubt that he had murdered the wife of his former employer. Singh, a native of Uttar Pradesh, was picked up by Delhi Police in 1999. Since he was an ex-employee and had left after a disagreement with his employer, police latched onto him after finding his fingerprint at the victim's house.
The prosecution maintained that Singh had confessed the crime. The husband of the victim also blamed Singh for the murder. He told the court that Singh had demanded Rs 50,000 from him. But when his demands were not met, Singh had left the job. After a trial of seven years, a session's court convicted Singh of murder in 2006 while relying on the prosecution's story.
Singh pleaded before the high court that it was natural for his prints to be found in the victim's house as he used to work there and also visited his former employees from time to time. Through his counsel, Singh pointed out that no fingerprints were recovered from the scene of crime.
His counsel also argued that police had to seek permission from a magistrate before taking his client's fingerprints. The issue of fingerprints led the HC to refer the matter to a larger bench for an authoritative ruling.
Unfortunately for Singh, two full bench rulings (of HC) returned with contradictory verdicts leaving Singh with no option but to move Supreme Court. His SLP in the apex court was also dismissed due to delay.
However, while deciding Singh's innocence, the HC bench relied more on lack of clinching proof and doubtful recovery.
