NEW DELHI: The Supreme Court has justified the much debated contempt of court powers saying it was necessary to "secure public respect and confidence in judicial process" and laid down what should be the tone, tenor and timing of a contemnor's apology. It upheld an Allahabad HC order rejecting an advocate's apology and sending him to a month in jail for committing contempt of court by leveling allegations against judges. However, it reduced the fine amount from Rs 20,000 to Rs 2,000, the maximum a court can impose on a contemnor.
A bench of Justices B S Chauhan and A K Sikri said, "Power of courts to punish for contempt is to secure public respect and confidence in judicial process. Thus, it is a necessary incident to every court of justice." It cautioned, "It is a rare species of judicial power which by the very nature calls for exercise with care and caution. It ought to be exercised where 'silence is no longer an option'."
