North Delhi Municipal Corporation (NDMC), South Delhi Municipal Corporation (SDMC) and East Delhi Municipal Corporation (EDMC) filed their response after the court on July 16 had sought their reply on a plea seeking quashing of the March 18 notification.
The municipal bodies told the court that among the conditions to be fulfilled under the Delhi Municipal Corporation (DMC) Act is that "no person suffering from any infectious disease shall be employed in such establishment".
"All persons working in the premises shall be medically examined and immunised. The certificate of medical fitness and immunisation shall be displayed prominently. A high standard of personal hygiene shall be maintained by the workers at all times. They shall wear clean aprons and head gears. No smoking, chewing of betel and use of snuff shall be allowed in the premises," the municipal bodies have said in their affidavit.
A bench of justices B D Ahmed and Siddharth Mridul, however, told the three municipal bodies to "rework" certain conditions to be imposed on street vendors after the National Association of Street Vendors of India (NASVI), which had challenged the March 18 ban on such eateries, objected to the conditions terming them "impractical".
The court, while asking the civic bodies to "re-work" certain conditions to be imposed on street vendors, fixed the matter for August 12.
The municipal bodies had imposed a ban on sale of edibles and beverages in the open from March 18 in areas under their jurisdiction.
