While hearing a PIL highlighting problems being faced due to absence of anti-graft ombudsman for Delhi, a division bench of Chief Justice G Rohini and Justice R S Endlaw asked additional solicitor general Sanjay Jain to take instructions from the central government on the appointment process and inform it.
The PIL sought direction to appoint a Lokayukta or extend the tenure of Justice Manmohan Sarin, the former Lokayukta chairperson, who demitted office last year. tnn
HC's poser came while hearing a PIL against Okhla legislator Asif Muhammad Khan for allegedly misusing public funds for beautification of a graveyard instead of providing basic facilities in his area. Filed by one Kamran Siddiqui, the PIL argued Khan should be restrained from misusing funds.
It also sought extension of the tenure of Justice Sarin as he had started inquiries in related cases and, as per the petitioner, the probe was in its last stage when his tenure ended. In absence of a new Lokayukta, Siddiqui contended, there has been no progress in the case.
The petition alleged that the MLA was misusing the Member of Legislative Assembly Local Area Development (MLA-LAD) fund for beautification of a graveyard in Batla House area and had spent Rs 2.8 crore on demolishing and rebuilding a boundary wall which was in a good condition.
Urging the HC to intervene the petitioner sought immediate directions to the government to appoint a Lokayukta so that pending enquiries can be completed and justice delivered.
