HC's direction came on a PIL seeking demolition of the "illegal" mall. A division bench of Justices B D Ahmed and Siddharth Mridul gave North Corporation till November 19 to apprise it of the circumstances in which the mall was built and if it is illegal. The court also tagged the petition with a case it is hearing on unauthorised constructions in the city.
Filed by NGO Pardarshita, the petition has alleged that the land on which Moments Mall is built, was originally sanctioned for a steel tank factory . NGO president Harkishan Das Nijhawan has alleged that mall is neither approved by the competent authority nor regularized by NDMC.Nijhawan has claimed they wrote to the NDMC commissioner but nothing has been done so far.
"Direct NDMC to demolish the illegal and unauthorised construction in Kirti Nagar which falls under the North Corporation's jurisdiction," the plea added.
