Special CBI Judge Swarana Kanta Sharma acquitted Anurag Vardhan, a 1994 batch IRS officer, R Perumal Samy, who was working as a PA to the then minister and A Krishnamurthy, a chartered accountant based in Chennai, observing that the CBI has not been able to prove the charges against them.
The CBI had chargesheeted them claiming that in 2003 Vardhan, who was posted in Delhi at the time, struck a deal with the others to pay Rs 4 lakh as bribe for his transfer to Mumbai.
"I am of the opinion that the electronic evidence in this case has not been proved as per mandate of law and therefore is inadmissible in evidence," the court said. It also said there were other major contradictions and discrepancies in the oral testimony of the witnesses and the documentary evidence, shaking the very foundation of prosecution's case.
The CBI had alleged that Vardhan had contacted Krishnamurthy, who had told him to pay Rs 4 lakh to Samy to be transferred to Mumbai. The agency claimed that on April 22, 2003, when Vardhan agreed to pay the bribe to Samy through Krishnamurthy, a team reached outside his house and nabbed
Perumal Samy and Padmanabhan when they were leaving the premises with the money. Samy told police he got the cash from Vardhan. During the trial, all the accused denied the allegations leveled against them.
During the arguments, advocate P K Dubey, appearing for Vardhan, told the court there were major contradictions in the statements of the witnesses.
