Not on Twitter but trending for online free speech: meet Shreya Singhal

DELHI: Shreya Singhal is not on Twitter. But the 24-year-old law student who challenged section 66A of the IT Act, was trending on the social networking site on Tuesday morning after the apex court struck the act down, terming it unconstitutional.

Singhal, who will be the fifth generation lawyer in her family once she formally qualifies, says she is thrilled with the judgment. However, the student, who says she has about 800 Facebook friends, cautions against taking this as a free pass for posting hate speech or defamatory comments.

"There are other provisions in the IT Act, and also in the IPC that deal with unlawful content," says Singhal, who filed a petition in the Supreme Court shortly after returning from her studies in the UK in 2012.

Back then, the Delhi University Faculty of Law student had been reading news reports about the arrests that had taken place in the country. That year alone, there had been at least six arrests under the act, many of them for posts against politicians. The turning point was the Palghar case, where two college-going girls were arrested for a Facebook post questioning the bandh in their city on the death of a political leader.

"I was so shocked. The post was so innocuous. I could have written it. If they got arrested, I or my friends could be arrested in the future too," says Singhal, who had a conversation about it with her mother, Supreme Court lawyer Manali Singhal.

"As it often happens at home, a discussion turned into a debate and an argument. I asked her, if you are so concerned, then why don't you file a PIL? Two days later she had the first draft ready. She had worked on it with a lawyer," says Manali Singhal, who then encouraged her daughter to work further on the PIL. While the win is a definite feather in the legal hat, Singhal senior won't be resting on the laurels. "Her career has not even started," she says.
