National Green Tribunal gives UP irrigation department four weeks to remove debris

NEW DELHI: Despite orders from the National Green Tribunal on September 17 to remove all debris dumped along the Yamuna bed with immediate effect, the Uttar Pradesh irrigation department has failed to take action. As a result, observing that the department "has scant regard to rule of law", the NGT has given it four weeks to take action and file a compliance report or face punitive action.

Expert member Dr GK Pandey and acting chairperson Justice AS Naidu observed that not only were no steps taken by the irrigation department to remove the debris, it had in fact asked for additional time to file its reply. "We are also satisfied that the inaction is in flagrant violation of the order passed by this Tribunal ... we take a liberal view and grant four weeks time to the said Respondent to remove all the debris from river Yamuna lying within the jurisdiction of UP State," said the order.

The order has named the chief engineer of the irrigation department, AK Gupta, as one responsible for removing the debris. The department has been given time till December 5 to file its compliance report with the tribunal.

The tribunal had issued its first order in March 2012 when it asked the ministry of environment and forest, Delhi Government, DDA, DPCC, UP Irrigation Department and Yamuna River Development Authority (to stop encroachment and dumping of solid waste in the riverbed within seven days of the order being issued. Subsequently when no effort was made to clear the river bed or stop further dumping, the tribunal issued fresh instructions, this time to land owning agency UP irrigation department, to remove all the debris lying along the river bank, "Irrespective of who had dumped it, more so because presence of debris in the locality not only causes pollution but also is hazardous to river eco-system, flow of water and to the inhabitants who use the water".

The area that has become the eye of the storm is along the Yamuna Pushta near Geeta Colony is east Delhi. A stretch of 80-100 m from the Pushta Road has been raised by 6-10 feet by dumping construction debris and water body has also been almost completely covered. The LG had also issued instructions to DDA to take care of the matter which said it was helpless since the land was not in their possession.
