Additional sessions judge Savita Rao convicted Brijesh Kumar on charges of attempting to commit culpable homicide not amounting to murder. He is likely to be sentenced next week.
Judge Rao on November 2 held Kumar guilty for causing injuries to Sanjay. Kumar had attacked Sanjay on his head with a screwdriver in east Delhi's Chandni Chowk Feb 2007.
The court order came after the convict admitted his offence during the trial.
Kumar told the court that Sanjay was injured during a quarrel with his father, Roshan Lal. He said that Sanjay had abused his father and tried to assault him and he in a fit of rage attacked him.
"He (Kumar) stated that the incident occurred in fit of anger and only in order to save his father ... he had the repentance and it was not intentional on his part to cause injuries to Sanjay," the court noted.
"Further, the medical record of injured Sanjay also corroborates the injuries caused to him and in these circumstances considering the statements of witnesses as
well as the own statement of the accused, the case is made out against the accused for the offence under section 308 (attempt to commit culpable homicide) Indian Penal code (IPC)," the court said.
The prosecution has examined seven prosecution witnesses to prove its case.
