Car hits Delhi school cab, 4 kids hurt

Written By Unknown on Kamis, 02 April 2015 | 22.10

NEW DELHI: Children from a school in northwest Delhi had a close shave when their cab was hit head on by a speeding car. The accident occurred close to Ashok Vihar when the kids were on their way to school on Wednesday morning.

Police said that the cab driver was critically injured. The car driver, on the other hand, fled from the spot leaving the vehicle behind.

The incident was reported near Satyawati flyover around 8am when the Maruti Omni carrying the children was taking a U-turn at a traffic signal. Eyewitnesses said that a Hyundai i-20 rushing down the flyover at the point hit the vehicle head-on when the driver failed to apply the brakes on time. Fortunately, none of the children were sitting in the front seat of the vehicle and escaped without any major injuries.

However, the cab driver, Narender, suffered severe head injuries. Police said that if it was not for his quick thinking the errant car would have hit the Maruti Omni on the side and injured the children. "The driver had turned the car to take the impact head on," said a police officer.

The three children sitting in the rear seat who were injured in the incident were identified as Kaniska (9), Abdul Shami, (10) and Apoorva (10). They suffered injuries on their hands and legs. They were rushed to a private hospital and were declared out of danger.

Narender was admitted to a government hospital where he had to undergo a head surgery on Wednesday evening.

Investigations have revealed that the i-20 car belongs to a businessman based in Model Town who had given the keys of the vehicle to a cleaner who had taken it for a ride without informing him. He said the cleaner was not an experienced driver and did not even have a license to drive.

A case under Section 337 IPC (causing hurt by act endangering life or personal safety) and negligent driving has been registered against the cleaner and a search has been launched to nab him.

Too many mishaps, rein in errant DTC drivers: Police

NEW DELHI: Concerned over the number of fatal accidents involving DTC buses, the traffic police have asked the transport authorities to rein in the errant drivers. The issue of frequent breakdowns of the buses has also been raised.

Traffic police data shows that DTC buses had killed more than 40 people in 2014 and this earned them the notoriety of going the "Blueline" way. Officials said cases of traffic rule violation are constantly rising and over-speeding by DTC drivers, despite speed governors in the buses, is a common complaint. This year, 10 people have already been killed by speeding buses. More than 100 DTC buses have been impounded for grave violations in 2015.

"We have been receiving complaints about every kind of violation by DTC buses and are seriously concerned about the way they are running on roads," said Muktesh Chander, special commissioner, traffic.

Often these buses are found parked in the middle of the road despite clear marking near the bus stops. They also violate stop lines and bus lanes very frequently. The traffic police have written to the PWD to redraw these lines for better visibility.

On March 24, the traffic police had to divert the route of a Union minister after a DTC bus breakdown at the Mother Teresa Crescent led to a huge traffic snarl on the stretch. Police officials said they have decided to warn the DTC officials about these repeated violations and will lunch a concerted drive to nab errant drivers.

In fact, a traffic police data shows that this year, nearly 40% of the commercial vehicles challaned for over-speeding were found to be DTC buses. Errant bus drivers were slapped a fine of Rs 2,000, said officials.

Case against Kejriwal: Sheila's secretary testifies

NEW DELHI: A trial court on Wednesday recorded the statement of former CM Sheila Dikshit's ex-political secretary who has filed a defamation case against Arvind Kejriwal for his alleged remarks against the Dikshit during protests over power tariff hike in October 2012.

The court also granted exemption to Kejriwal from personal appearance for the day after his counsel moved an application on the ground that being the chief minister he was engaged in meetings through the day and had no objection if the complainant's evidence was recorded in his absence.

"He has utmost respect for the judicial process and his absence in Wednesday's proceedings is not willful or intentional," Kejriwal's counsel said.

During the hearing, chief metropolitan magistrate Savitri recorded the statement of complainant Pawan Khera who testified that Kejriwal had used "foul and filthy" language against Dikshit in a television show in 2012.

Khera, former officer on special duty and political secretary to Dikshit, said due to Kejriwal's language, said his reputation and esteem as well as of others working with the then CM had been lowered in the eyes of public, friends and social circle.

SA smuggler arrested at IGI, Delhi cops flush out 1.3kg cocaine

NEW DELHI: A South African was arrested by sleuths of the Narcotics Control Bureau for allegedly smuggling around 1.3kg of cocaine by swallowing 65 pellets of the drug, each weighing 20 grams. Officials have called this haul one of the biggest in cases of swallowed contraband recoveries and estimate the cost of the drugs to be around Rs 6.5 crore.

The accused, identified as Bobby Collins Anagar (42), had arrived in Delhi by an Emirates flight from Sao Paulo via Dubai on March 29. The accused was nabbed after his behaviour was found suspicious by officials.

"Anagar was intercepted at IGI Airport. While his personal and baggage search did not reveal anything, his continuous refusal to eat or drink indicated that he was carrying the drugs inside his body," said NCB zonal director Rohit Sharma.

Interestingly, Anagar had taken the same route as two other South African nationals who were arrested with 9.6kg of cocaine last week.

"During prolonged questioning, he started getting restless and requested the officers to provide him medical aid to allow him to pass the capsules," Sharma added.

The accused was then taken to Safdarjung hospital where a CT scan and an X ray revealed the presence of the substance in his abdomen. "Anagar was kept under supervision for two days till he passed the pellets in his stool in a phased manner. Any efforts at forced ejection of stool could have resulted in a rupture and even a single pellet burst in the gut could have killed him due to drug overdose," the official added.

Officials said that each pellet was roughly 4-5 centimeters and encapsulated in a cellophane covering. NCB was in touch with Delhi Police and other intelligence agencies to ascertain Anagar's involvement in previous cases. The accused had reportedly visited India twice in 2014 on a "business trip". Senior officers said that professional 'swallowers' are known to carry 500-600 grams of drugs in their gut across international borders.

New anti-harassment law leaves DU's sexual minorities vulnerable

Written By Unknown on Rabu, 01 April 2015 | 22.10

NEW DELHI: With the Ordinance XV-D on sexual harassment gone, sexual minorities in Delhi University have had to take a "regressive step". Now replaced by the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013, Ordinance XV-D had been, by all accounts, balanced, thorough and, perhaps most importantly, gender-neutral. Without it, the campus' gays, lesbians, bisexual and transgender students - and even boys - will have to combat sexual harassment by invoking anti-ragging rules or the code of professional ethics. Sexual harassment of these students can't be reported as just that; the policy, apparently, doesn't acknowledge that they can be harassed too.

Troubled by this "regressive step" - as Kirori Mal College student Aapurv Jain describes it --- DU's Gender Studies Group is launching a campaign and will petition the vice chancellor to consider adopting a different policy. "The Ordinance XV-D had been in operation for nearly 10 years and was one of the best policies in the country," says former DU teacher -- the first one to be openly gay --- activist, Ashley Tellis, at a recent meeting of the GSG on the subject. Tellis had also been a part of the committee that framed Ordinance XV-D. "There was representation from all levels - from the karamcharis to faculty. It was gender-neutral." It also came with a broad definition of harassment.

Delhi University's executive council decided to replace the ordinance with the 2013 law in March 2014, notifying the change in June. "The law assumes men are the only perpetrators and women - presumably straight and cisgender women - their only victims," as Jain says.

But members of the community in DU can attest to the fact that harassment by women, of LGBT students by the same sex and of boys, are all common. Tellis, who's taught at St. Stephen's, Kirori Mal and Ramjas, says he was "systematically harassed by students." He had underwear and images cut out from pornographic magazines stuck on his door at one; faculty members left homophobic comments on his mail at another. He also had harassment cases filed against him -- by a male and female student - but is yet to see a formal complaint or any evidence of due process being followed. Then, in 2008, the Ramjas College vice principal was accused of sexually abusing about a dozen students - all male. Jain speaks of being constantly stared at; another student talks about classmates making advances. "Men harass in groups. A transgender student attended a Delhi college for one year and faced a lot of harassment - from teachers, students and the administration," says Jain.

Gender groups in colleges rarely talk about homosexuality. Tellis had formed Parivartan - a gender group - with another colleague at KMC. "Homosexuality was never talked about." Jain points out that it still isn't. A lesbian student attending a women's college says that many at her college objected to having a sexual harassment committee at all. "They asked why we need one in an all-women's college?" Tellis also argues that LGBT students "need trained counselors."

SC notice to Advani, others on plea challenging dropping of charge

NEW DELHI: The Supreme Court on Tuesday issued notice to L K Advani and 20 others, including Murli Manohar Joshi and Union minister Uma Bharati, on a fresh plea seeking restoration of conspiracy charges in the Babri Masjid demolition case.

Haji Mahboob Ahmed, a resident of Ayodhya who was examined as a witness in the case against Advani and others, filed the fresh plea. Ahmed is also a party to the original civil suit filed in the district court.

The Allahabad high court had on May 20, 2010 discharged Advani and the others of conspiracy charges. CBI filed an appeal on February 9, 2011, after a delay of eight months which it attributed to the "cautious approach" of those concerned with filing the appeal.

Appearing for Ahmed, senior advocate Kapil Sibal's request for issuance of notice to the respondents, including Advani and 20 others as well as CBI, was accepted by a bench of Chief Justice H L Dattu and Justice Arun Mishra though the appeal (Ahmed's) was filed after a delay of 1,680 days (since 2010 verdict). This petition, if heard by the court after condoning the delay, would keep the case alive politically though the UPA government did not appear to take mileage out of the case when it was in power for 10 years at the Centre.

Additional solicitor general Neeraj Kishan Kaul had earlier informed the bench that the CBI had filed an affidavit explaining the delay in filing appeal against the Allahabad HC judgment in April 2013 and the agency had nothing more to add. The CBI had told the SC on April 16, 2013 that everyone concerned with filing of the appeal against Allahabad HC 2010 judgment had adopted a "cautious approach".

The limitation period for filing the appeal expired on August 29, 2010 but CBI had moved the SC only on February 9, 2011, after a delay of eight months and the court had asked the agency to explain the delay as the counsel for the accused sought dismissal of the appeal on ground of huge delay.

Narrating the movement of files relating to filing of the appeal, the CBI had said, "The delay has been occasioned because everyone associated with the matter was cautious, keeping in mind the sensitivity involved in the matter and wanted to exercise due diligence in the matter." The counsel for the accused had sought dismissal of the CBI's appeal on the ground of delay.

The bench of Justices Dattu and Mishra told all the counsel that it would hear the matter both on the grounds of delay and on merit.

However, the case got a new twist with Ahmed's petition. Filed through advocates M R Shamshad and Farrukh Rasheed, the plea said, "The HC failed to appreciate the scope and nature of Section 120B of IPC (conspiracy). A reading of the section shows that the offence of criminal conspiracy is a separate offence by itself. In the present case, the charge of Section 120B IPC runs like a common thread in respect of each and every offence and in relation to each and every accused person.

"The HC in its February 12, 2001 order had ratified the consolidated charge-sheet which included the offence under Section 120B IPC against the eight accused persons in crime No.198/92 (the FIR against Advani and others) as well as other accused persons. Therefore, the finding of the HC in the May 20, 2013 judgment was erroneous."

In the next hearing, the court will hear the counsel for the accused and decide whether the eight-month delay on part of CBI and five years on part of Ahmed could be condoned and if conspiracy charge against the accused be restored.

Delhi HC helps Muslim woman live with Hindu husband

NEW DELHI: Coming to the aid of a young Muslim woman who alleged threats from her family after she married a Hindu, the Delhi high court has allowed them to live together.

Justice Sanjeev Khanna and Justice Ashutosh Kumar told the woman's parents not to interfere in her personal life, saying she was over 18-years old and wanted to live with her husband.

The March 24 order came on a habeas corpus plea of the husband Akash, 21, who alleged that his wife's parents were against their marriage and feared they might get her married to someone else.

"We have spoken to the girl and she has stated that she would like to go and live with Akash who is her husband," the bench said.

When the case came up for hearing in December 2014, the woman told the court that she had gone willingly with Akash from Delhi to Noida and then returned home of her own will.

Admitting she was married to Akash, she said she was never detained by Akash against her wishes.

She also stated that she wished to reside with her parents and expressed a desire not to lead a married life for the next three years.

The bench then ruled that she could remain with her parents and stay with them in Delhi. The parents were told not to get her married and the police were directed to ensure compliance.

But in January, Akash filed an application before the bench saying his wife had told him on phone that she was taken to Meerut in Uttar Pradesh and he apprehended that she was being married to another person.

The court then asked police to ascertain her whereabouts. After the police failed to locate her, the bench summoned the woman and her father.

The woman told the court that she was beaten by her family members who wanted her to marry another person. She expressed a desire to live with her husband.
