The latest order, issued on May 7, 2014, directed DoE to issue notices to schools with facilities to reserve two seats for children with special needs (CWSN) for this academic year and to do it "within 24 hours from today (May 7)"; DoE hasn't. The department has, in fact, filed a review petition.
DoE had submitted in HC that 18 schools inspected by them have the facilities required to educate CWSN; 19 do not and another eight are yet to be inspected. HC directed DoE "to issue an appropriate circular to these 15 (18) schools to reserve at least two seats for children with special needs for the current academic year 2014-15 at the nursery level." It ordered DoE to also issue notices to the 19 schools without facilities "on the question of admission to children with special needs and the extent to which such facility can be given for the current academic year." The HC ordered DoE to do this within a day "considering the fact that finalization of the admission process is imminent in view of the orders of the Supreme Court." Previous orders of the HC directing the department to keep few seats vacant for the disabled also went un-notified.
DoE had undertaken the inspection of the schools' facilities for the disabled following another HC order dated April 3. The group of parents who'd gone to court over nursery admissions for disabled children had furnished a list of 43 schools that, till the 2013-14 session had allotted points to disabled children. This year, when the points distribution was fixed, there was no separate category for CWSN as they are already counted among the disadvantaged categories, and with the economically weaker sections, entitled to seats in the 25% free-ship quota. But the number of EWS applicants was so high that the chances of CWSN actually getting a seat were negligible.
"We have filed a review petitions because the Supreme Court has ordered the admission process to start and that admissions already made can't be disturbed. How can we change directions again?" says Padmini Singla, director, education.
"We've come so far. We've even won the legal battle but we don't seem to get beyond the DoE. Everyone seems to agree these children have to be admitted, even the schools. We are really disappointed with the department," says Amita Garg, one of several parents of CWSN in a fix this year.
The Supreme Court on Wednesday lifted the stay on nursery admissions in Delhi and held that parents who have moved court against the Delhi government's decision to scrap the Inter-State Transfer (IST) will get seats in schools for their toddlers this academic year. The DoE notified the Supreme Court order on nursery admissions on Thursday evening.
