The deceased have been identified as Nikhil Bansal (40), who owned the car and was sitting in the front passenger seat, and his brother Vineet (36), who was sitting behind him on the left side. A distant relative, Pradeep Bansal, was in the rear-right seat, and a cousin , Nitin Bansal (32), was driving , police said.
Deputy commissioner of police (northwest district) N Gana Sambandhan confirmed that the driver had tested positive for alcohol. "We have registered a case under sections of rash driving and causing death due to negligence (sections 279 and 304A of IPC). The driver will be booked under Section 185 of the Motor Vehicle Act. Further investigation is in progress ," he said. Nitin will be arrested on being discharged from hospital, police said.
The accident occurred around 12.30am near the Britannia Chowk flyover. The car (DL 8C L 6220), police said, was being driven at a very high speed and was heading towards Dhaula Kuan from the Azadpur side.
"Near the petrol pump's exit , the driver lost control over the steering. The car swerved in a wide arc and hit the petrol pump sign before ramming into an electricity pole. It rose in the air after hitting the pavement underneath the sign, spun around and landed on its left side. It also dragged on the ground for a few metres before coming to a stop," said a senior officer.
"We heard a screech followed by a bang and rushed to see what had happened. The car was lying on its side near the pole. We informed police, who reached here within five minutes," said an employee of the petrol pump.
The fire department was called as the occupants were trapped in the mangled car. They were pulled out after cutting open the car with gas cutters , and rushed to Maharaja Agrasen Hospital. Police said the car's airbags had deployed but the two men on the left suffered grievous head injuries as the car landed on that side.
Nikhil and Vineet were declared dead on arrival while Nitin was admitted with critical injuries. Pradeep was declared out of danger. Their medico-legal examination was done and an FIR was registered at Keshavpuram police station on the basis of the PCR call and apolice officer's statement.
Family members said Nikhil and Vineet were sons of Mohan Bansal, owner of a steel factory in outer Delhi. Both were married and had children . They had probably left their CC Colony house after the party to drop Nitin at his house in Gurgaon. "Both of them looked after their father's business ," said a family member, adding, Nitin owns a garment business in Gurgaon while Pradeep helps him.
Crime and forensic experts who inspected the scene of accident and the car, said that the impact of the collision and the condition of the vehicle suggested that it was being driven at more than 100kmph. The bodies were handed over to the family after postmortem on Wednesday but the accident cell will further investigate the case, police said.
