NEW DELHI: Sentencing a man to jail for three years in a cheating case, a trial court has said the fundamental right to earn livelihood cannot be exercised by duping others.

Refusing to show any leniency towards Deepak Maingi, a resident of Haryana, for cheating one Pushpa Chaudhary, metropolitan magistrate Pawan Singh Rajawat also directed him to pay a compensation of Rs 3.50 lakh for duping the victim.

"He induced innocent people to hand over the money on the pretext of depositing the same and then ran away. Moreover, the act of the convict resulted not only in mental agony for the complainant but also caused huge financial loss. Hence, I am satisfied that the convict deserves no leniency as he cheated the complainant," the judge said.

On August 28, 2012 Pushpa, along with her father-in-law, was standing at a cash counter in the SBI branch at Tis Hazari courts for depositing court fees. When the lady cashier asked them to deposit a copy of PAN card, her counsel went outside the bank to get it. In the meantime, Deepak took them to a counter and asked them to hand over the cash to him. On receiving the money, Deepak started walking away slowly and then ran away from the bank.

Deepak sought leniency from the court on the ground that he was the sole bread earner and has to look after his family.
