E-rickshaws, e-carts notified, can ply again

NEW DELHI: The government has finally issued notification to allow two new battery-operated vehicles, e-rickshaw and e-cart, in the three-wheeler category to ply on roads. While e-rickshaws are meant for passengers, e-carts will be allowed for goods transportation and these have to be registered. The drivers need to get driving licence from local transport departments.

As per the gazette notification, e-rickshaws can carry four passengers and 40 kg luggage while e-carts can only be used for goods transportation up to 310 kg. Local municipal bodies and traffic police will regulate plying of these vehicles in the areas so that there is no overcrowding of vehicles.

The recognition of e-rickshaw as a motor vehicle means there will be third party insurance and victims of road accidents in these vehicles will be entitled to get compensation under the motor vehicle law.

While the notification clearly says that all new models and vehicles have to comply with all recently notified norms and there will be some kind of type approval, the road transport ministry has come to the rescue of existing e-rickshaws by creating a provision of "sample test" per model.

According to the notification, the existing e-rickshaws will be registered after one sample of each model passes tests by the government approved agencies. The registered e-rickshaw associations have to submit the list of models to local transport department by November 30. This has been allowed despite the government being aware that no manufacturer or assembler of these imported vehicles followed a specific standard and therefore, every model has different variants.

IFTRT, a think tank on transport issues, has alleged that in order to honour the commitment of road transport minister Nitin Gadkari to e-rickshaw lobby, the government has "bypassed the basic objectives, letter and spirit of Motor Vehicles Act". It alleged that Central Motor Vehicle Rules (CMVR) does not permit old/ used motor vehicle to be submitted for certification. Instead it mandates that only prototype of every motor vehicle is subject to test by the testing agency. Moreover, the rule also mandates that every vehicle manufacturer has to issue a quality certificate for tyres.
