NGT seminar to hamper court work today

NEW DELHI: Even though October 18 will be a working Saturday for more than 40 subordinate courts in Delhi, they will be mostly adjourning cases of litigants and handing out fresh dates. This is so because presiding judges of civil, magistrate and sessions courts have to attend a daylong seminar in Vigyan Bhavan to celebrate the Foundation Day of National Green Tribunal (NGT).

TOI has accessed a circular issued by Delhi high court Thursday listing names of 43 judges from Delhi judiciary nominating them to attend the NGT seminar.

Incidentally, civil courts no longer deal in environment disputes since a majority of them stand transferred to the Tribunal and its various branches. What has left the judges puzzled is that their attendance at the seminar will come at the expense of work in sessions, civil and magistrate courts across Delhi, something sanctioned by the HC administration.

When contacted, the HC administration refused to come on record but explained the circular on the ground that judges will benefit from disaster management lecture scheduled at the NGT function.

The move, however, has led to a lot of heartburn in the lower judiciary. When TOI spoke to some of the judges, in off-the-record conversations, they pointed out that participation in such functions which have no direct correlation to judicial work only piles up already high pendency of cases.

"We ask ourselves what is the take-away from attending such a seminar on a working day when we are supposed to decide cases and reduce pendency. Saturday's function involves speeches by NGT chairman, Union ministers for environment and power and one session on disaster management. At best it might have tangential impact on our core work of adjudicating cases," one of the nominated judges said.

While serving judges remained tightlipped, former Delhi HC judge Justice SN Dhingra took a dim view of the HC circular wondering why courts should remain unmanned on a working day.

"On the one hand, Delhi high court says we want to dispose of cases and reduce high pendency. On the other, they destroy 43 working days by a single circular. These are basically window dressing orders, where court administration becomes unmindful of litigants, accused, and witnesses. These are the people who will suffer from adjournments. The cause lists of courts must be full of cases," said justice Dhingra, who has been Delhi's district judge before his elevation to HC.
